Welcome to www.dohafilminstitute.com (the “Website”) operated by the Doha Film Institute (“DFI”, “we”, “our”, or “us”). The Website is intended to enable visitors to the Website (“you” or “your”) to view and learn about us and our films. DFI is a non-profit organisation dedicated to film appreciation, education, and building a dynamic film industry in Qatar that focuses on nurturing regional storytellers while being entirely global in its scope. With education culture, community, and entertainment at its foundation, DFI serves as an all-encompassing film hub in Doha, as well as a resource for the region and the rest of the world. 1. Use.

Please read these terms of use (the “Terms of Use”) carefully before accessing the Website. By accessing the Website, you acknowledge and agree that you have read this Terms of Use, are at least eighteen (18) years of age, and will be bound by the terms and conditions set forth in the Terms of Use. If you are under eighteen (18) years of age you must obtain your parents’ or guardian’s consent to use this Website. Additional terms and conditions may apply to certain portions of the Website, and your use of such portions of the Website indicate your agreement to such terms and conditions. DFI reserves the right to modify the Terms of Use at any time. We will indicate that changes to this Terms of Use have been made by updating the date indicated after “Last Modified” at the end of this Terms of Use. You agree to review these Terms of Use periodically to be aware of such modifications. You further agree that your continued use of the Website shall be deemed to be your conclusive acceptance of any modified Terms of Use If you do not agree to abide by any modified version of this Terms of Use, you are not authorized to use this Website. A current version of the Terms of Use is accessible via the footer of the Website’s homepage.

2. User Accounts

2.1 User Registrations — Accurate Information. In order to make use of certain functionality on the Website and/or purchase our products, you may need to register and create a user account on the Website (“Account”). You agree to provide us with accurate, complete and current information at all times. You may receive an activation email which will enable us to confirm your email address and to make sure that you will receive any correspondence such as receipts for online purchases.

2.2 User ID — Password. Website users who create an Account will obtain a user ID and password (“Profile”). You agree not to allow any third party to use your Profile to access the Website and to safeguard the information that would allow another person or entity to access the Website by using your Account. You agree to be responsible for your failure to safeguard such information and/or to allow any other person or entity to access the Website by using your Profile or otherwise using your Account. No part of a Profile or Account may be transferred or sold to another party by you. You agree to notify DFI immediately of any unauthorized use of your Profile, Account or the Website. You agree that DFI shall not be liable for any loss that results from the unauthorized use of your Profile or Account, either with or without your knowledge.

2.3 Revocation of User Accounts — You agree that DFI has the right to cancel your account and/or revoke your Profile for any reason at any time, in our sole discretion, and you agree that DFI shall have the right to take appropriate administrative and/or legal action, including criminal prosecution, to protect our interests.

3. Copyright, Patents and other Intellectual Property Rights.

All content contained on the Website, including but not limited to video, clips, photographs, text, graphics, logos, icons, images and software (collectively, “Content”), is the property of DFI , its affiliates and/or their respective licensors and is protected by Qatar and/or international copyright laws, or other intellectual property laws. Any reproduction, modification, distribution, transmission, republication, display or performance of the Content contained on the Website is strictly prohibited. However, unless otherwise expressly prohibited on or in association with the Content, you may print copies of any Content or portion thereof contained on the Website for your personal use only. If you use material appearing on the Website contrary as set forth in the Terms of Use, you may be liable for infringement, misappropriation or other causes of action that may be exercised against you the fullest extent of the law.

4. Trademarks.

Unless otherwise indicated, all names, graphics, designs, logos, page headers, button icons, scripts, commercial markings, trade dress, and service names included in the Website are trademarks of DFI or its licensors or suppliers (collectively, the “Trademarks”) and are protected by the trademark laws of Qatar and other jurisdictions. You may not use, copy, reproduce, republish, distribute, modify or post any Trademarks in any way, including in advertising or publicity pertaining to or distribution of materials on the Website, without our prior written consent. The Trademarks may not be used in any manner that is likely to cause confusion, or in any manner that disparages or discredits us.

5. Content Generated by Users.

In certain areas on or website, you may be able to post reviews, comments, photos, submit suggestions, ideas, comments, questions, or other information (“User Generated Content”). You may post User Generated Content provided such content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties.

You hereby agree not to use the Website as a platform to:

  1. Bully, intimidate, threaten or harass any user.
  2. Upload, post, or otherwise make available any content that is unlawful, defamatory, pornographic, contains nudity, hateful, incites violence, obscene, invasive of another’s privacy or is otherwise objectionable;
  3. Upload, post, or otherwise make available any content that you do not have a right to make available, including any confidential information;
  4. Upload post, or otherwise make available any content that infringes any intellectual property rights of any party;
  5. Upload photographs or other personally identifiable information of third parties without their consent;
  6. Upload, post or otherwise make available any unsolicited or unauthorized advertising, promotional materials, “junk mail”, “spam”, “chain letters” or mass mailings;
  7. Upload, post or otherwise make available any material that contains software viruses or any other malicious code; and
  8. Upload, post or otherwise make available any political or religious lobbying or statements for commercial advantage.

DFI reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content. If you do post content or submit User Generated Content, and unless we indicate otherwise, you hereby grant DFI a nonexclusive, worldwide, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant DFI and sublicensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify DFI for all claims resulting from content you supply. If you do not wish to grant this licence to DFI, please do not submit User Generated Content.

DFI has the right but not the obligation to monitor and edit or remove any activity or content. DFI takes no responsibility and assumes no liability for any content posted by you or any third party.

6. Website Purchases and Ticketing Policies.

6.1 Ticket Policies and Venue Procedures. — All ticket sales are subject to the following:

  1. All seats are general admission, unless seat location is identified on the ticket face. All events require a ticket to attend unless otherwise noted. Receipt of purchase shall not be sufficient for entry.
  2. All ticket holders must be present at the venue at least 30 minutes prior to scheduled start time. Entry may be refused if you fail to be present on time.
  3. The right of admission is reserved. DFI reserves the right to refuse entry or to remove from the venue any persons who are drunk, or disorderly, offensively attired or whose conduct is unlawful or offensive or who are not entitled to attend the Event. Any person who causes a disturbance or who refused to comply with reasonable requests from DFI or venue operators may be removed from the venue. Entry may be refused for tickets that are defaced, damaged or not purchased through DFI or its authorised outlets.
  4. For Events that are subject to minimum age restrictions/ratings, such as 18+, DFI reserves the right to require presentation of photo identification to confirm an individual’s age and to refuse entry to any person not meeting the required minimum age.
  5. Tickets for online sales can be picked up at the Box Office locations identified for the specific Event. Ticket holders must produce valid identification and the receipt emailed to the email address provided at registration. Please keep the receipt secure. DFI shall not be responsible for duplicate copies of the receipt and only the first copy provided to DFI shall allow the bearer access to tickets.
  6. Vouchers are not sufficient for entry to the Event. Vouchers must be submitted to a Box Office location and a ticket issued. Please keep the voucher secure. DFI shall not be responsible for lost or duplicate copies of the voucher. The first voucher presented shall entitle the bearer to receive tickets.
  7. All Voucher, Pass and Cardholders must present a ticket to access Events; vouchers, pass or card alone does not grant admission, unless otherwise noted.
  8. Students must present valid ID to receive discount, when available, on tickets. Student discounts are only applicable for the student card holder and not for other family members or friends. DFI reserves the right to charge the difference between full priced tickets and any student prices purchased in violation of this requirement.
  9. Ticket holders, Pass Holders and Card Holders hereby agree and provide their consent to DFI and its designees to utilize holder’s image or likeness in connection with any live or recorded transmission or reproduction of the Event to which the ticket relates. Ticket holders, Pass Holders and Card Holders voluntarily assume all risks and danger incidental to the Event for which the ticket is issued, whether having occurred prior to, during or after the same at the Event and any other related function. Ticket holders, Pass Holders and Card Holders voluntarily agree that the facility, DFI and all of their respective agents, officers, directors, owners and employees are expressly released by holder from any claims arising from the Event to which the ticket relates, unless such exclusion is prohibited by law.
  10. Tickets may not, without the prior written consent of DFI, be resold or offered for resale (including via online auction sites) or used for advertising or promotion or other commercial purposes (including prizes in competitions). Any tickets sold or used in this manner may be declared void and entry refused for the ticket holder.
  11. Cameras, audio and video recording equipment are not permitted in the Event. Mobile telephone devices with recording capabilities may not be used within the venue. DFI reserves the right to search individuals and/or their possessions for such equipment and/or exclude entry to any person with such equipment in their possession. DFI may actively monitor the venue for such equipment and any person found to be using recording equipment within the venue may be prosecuted to the fullest extent permitted by law.
  12. For security purposes, it may be a condition of entry to certain venues or events that individuals submit themselves to a search or person and/or their possessions.
  13. Rush sales are not available at all Events. Where Rush Sales are available for sold out Events, Rush Sales lines will form at the Event venue approximately 45 minutes prior to scheduled start time. Admission will begin approximately 5 minutes before program start time based on availability. Admission is not guaranteed. Rush sales are CASH ONLY.
  14. For same-day ticket sales please review the website for the Event to locate available Box Office locations and the opening and closing time.
  15. Customers may purchase a maximum of five (5) tickets per Event per online transaction.
  16. All venues are non-smoking unless otherwise expressly permitted.
  17. ALL SALES ARE FINAL. No refunds, exchanges or reprints.

6.2 Online Products. — Tickets to screenings and other products for Events of DFI are offered for sale through the DFI Website. In the event you wish to purchase any of these products on line, you will be asked by DFI or an authorized third party on DFI’s behalf to supply certain information, including without limitation, your full name, address and credit card information. You agree to provide us or such third party with accurate, complete and current information at all times, and to comply with the terms and conditions of any ancillary agreement that you may enter into which governs your purchase of such service. You shall be responsible for all charges made under your profile as well as for paying any applicable taxes. All transactions made for ticket sales will be charged in Qatari Riyals (QAR).

6.3 Payment. — Your right to any product that is available for purchase through the Website is conditional on our receipt of the appropriate payment for such product. If such payment cannot be charged to your credit card or if a charge is refunded for any reason, including chargeback, you agree that we reserve the right to cancel your order and/or suspend or terminate your account. We use a third party payment provider to process payments. All payments are processed by this third party’s payment gateway which provides a secure method for authorizing card transactions over the Internet. This third party provider is responsible for the capture and use of your credit card details. We do not have access to your credit card information and we are not responsible for any misuse of your credit card information. You hereby agree that you shall not use any credit card which you are not authorised to use. Where you are using a parents or guardians credit card, you hereby agree that your parent or guardian shall submit the relevant information and make the online payment. Receipts of purchases shall be emailed to you at the email address provided at registration.

6.4 Risk of Loss. — You acknowledge and agree that your only remedy for failures, delays or interruptions with respect to the ordering of and delivery of products ordered by you through the Website is limited to a refund for such products, in DFI’s sole discretion. All products ordered through the Website are acquired by you "as is" and "where is".

6.5 Product Descriptions. — We attempt to be as accurate as possible in describing products (including pricing) offered for purchase through the Website; however, we do not warrant that all such descriptions are complete, current or error-free. DFI reserves the right to add, withdraw, reschedule or substitute products and/or vary advertised programs, prices, venues, seating arrangements and audience capacity.

6.6 Returns. — All tickets sold to you by DFI on DFI’s Website are final and no refund or exchange on any ticket except as required by law shall apply. If a refund is made, DFI may, to the extent permitted by law, retain any fee it has charged. No ticket reprints are available.

7. Links.

DFI and/or third parties may provide links to other websites of possible interest to you. Because we have no control over such websites, you acknowledge and agree that we are not responsible for the availability of such websites and do not endorse and are not responsible or liable for any content, advertising, services, products, or other materials on or available from such websites. You also acknowledge and agree that DFI shall not, to the fullest extent permitted by law, be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, advertising, services, products, or other materials on or available from such websites. All such websites shall be subject to the policies and procedures of the owner of such websites.

8. Disclaimer of warranties.

8.1 — You acknowledge and agree that your use of the website is at your sole risk. DFI does not make any representation or warranty (i) as to the accuracy, correctness, completeness or usefulness of any content appearing on the website and is not responsible for any errors or omissions in any content appearing on the website, or (ii) generally for the accuracy, reliability, or quality of any content appearing on the website. DFI is not responsible for any failures, delays or interruptions of the website. The website is provided to you "as is" and DFI makes no representation or warranty of any kind to you, either express or implied. Specifically, DFI disclaims any implied warranties of title, non-infringement, merchantability, and fitness for a particular purpose.

8.2 — You acknowledge and agree that under no circumstances will DFI be liable for any loss or damage caused by your reliance on content obtained through the website or caused by your conduct. DFI does not guarantee continuous, uninterrupted or secure access to the website, and the operation of the website may be interfered with by numerous factors outside of our control.

9. Limitation of liability.

9.1 — In no event shall DFI be liable for indirect, incidental, special, consequential or punitive damages, arising out of or in connection with your use of the website, including without limitation for lost profits or business, or anticipated lost profits or business, even if advised of the possibility of such damages. DFI’s or its affiliates aggregate liability to you or any third party in any circumstance arising out of or related to the website or this agreement is limited to Five Thousand Qatari Riyals (QAR 5,000).

9.2 — Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for indirect, incidental, special, consequential or punitive damages. Accordingly, some of the above limitations in sections 8 or 9 hereof may not apply to you.

10. Indemnification.

You agree to indemnify, defend and hold DFI harmless from any claim, expense or demand, including without limitation reasonable attorneys’ fees, made by any third party due to or arising out of your breach of this Terms of Use, or your violation of any law or the rights of a third party.

11. Commercial Use.

Aside from purchase made by you through the Website, you acknowledge and agree that the Website may not be used by you directly or indirectly in connection with any commercial endeavors.

12. Privacy.

DFI is committed to safeguarding your privacy. The terms regulating the handling of personally identifiable and other information in connection with the Website is described in our Privacy Policy, which can be found http://www.dohafilminstitute.com/legal

13. Governing Law.

You acknowledge and agree that this Terms of Use shall be governed by and construed in accordance with the laws of the State of Qatar, excluding conflict of laws provisions thereof that would indicate the application of the laws of any other jurisdiction and you hereby submit to exclusive jurisdiction in the courts of Qatar. You agree to receive service of process through certified mail or by other means sanctioned by law, and you expressly waive any claim of improper venue and any claim that such courts are an inconvenient forum.

14. General.

If any provision of this Terms of Use is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. You agree that this Terms of Use may be automatically assigned by DFI, in its sole discretion, to a third party. Section headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. This Terms of Use, along with any other terms and conditions regulating use of the Website, sets forth the entire understanding and agreement between us with respect to the subject matter hereof. The provisions of this Terms of Use and any ancillary terms and conditions will survive termination or expiration to the extent necessary to carry out the intentions of the parties.

How does the Website work?

The Website offers visitors to the Website (“you” or “your”) the opportunity to browse the Website and use certain features on the Website. DFI reserves the right to change how we handle the information we collect through the Website at any time. What type of PII does DFIcollect from you and how do we use it?

DFI does not require you to provide us with any PII. Unless you provide your PII to DFI through the Website, we will not collect any PII from you. If we receive your Opt-Out Request after having shared your PII with a third party, DFI may not be able to control use of such PII by such third party (or any other party to whom such third party may have transferred your PII). In such an event you agree that DFI shall not be responsible or liable, directly or indirectly, for damages or loss caused or alleged to be caused in connection with the use of such PII by any such third party or resulting from any such transfer or disposition. If you are concerned about DFI sharing your PII with third parties or otherwise transferring or disposing your PII, you should not provide your PII to DFI. What other information does DFI collect?

We also may collect anonymous and aggregate information from you about your preferences in navigating the Website by using cookies, action tags and other methods. Cookies are small text files that identify your computer. We may use cookies to, among other things, monitor Website usage, customize Website features, identify your computer’s operating system and browser, and complete transactions. An action tag is a small, graphic image on a webpage that is designed to allow the website owner or a third party to monitor who is visiting a website by collecting the IP address of the computer to which the tag is sent, the URL of the webpage that the tag comes from and the time that such webpage was viewed. Does DFI provide links to other websites?

DFI may provide links to other websites or resources of possible interest to you. Because we have no control over unaffiliated websites to which we provide links, the collection and use of your PII and other information by such websites shall be subject to the policies and procedures of such websites and not this Privacy Policy.

What are our policies regarding children?

You must be eighteen (18) years of age or older in order to use the Website. If you are not 18, please obtain your parents or guardians consent.
